1. General:
The person or persons who has rented or provide payment on account of a booking are hereafter referred to as the “Vacationer/ Renter” or vice versa.
2. Contract:
By selecting “I Agree, Reserve this Property” on the booking interface of the cottagewhitelake.com web site or communicated and rented vide email confirmation, the Vacationer understands and agrees that they are entering into a legal binding contract between the Vacationer and Cottage Owner as per the authority Ontario Electronic Commerce Act, RSO 2000. The issuance of a written or electronic confirmation to the Vacationer by the Owner shall complete a binding contract between the Vacationer and the Cottage Owner.
3. Limitations of Liability:
The Vacationer represent, warrants, acknowledge and agrees with Cottage owner that they will use the cottage and its facilities in accordance with the terms and conditions of this agreement and the house hold rules and that they do so at their own risk and that they indemnify and save the Property Owner or any agency working for booking on behalf of the owner, harmless from any claim made as a result of personal injury, sickness or death, loss or damage caused, to person or property of the Vacationer or their family, guests, visitors, servants and agents during or after the time of occupancy. Further, the Vacationer accepts full responsibility of the use of any recreational equipment, such as boats, motors, playground equipment’s etc. and agrees to pay for any repairs to damage to or replacement of said equipment, if caused by the vacationer or any of their family, guests, visitors, servants and agents.
4. Credit Card Guarantee:
The Vacationer agrees to provide a valid credit card number as a guarantee addition to advance damage deposit.
To pay all liability for any damage beyond normal wear and tear during the term of the Vacation. Also agrees to pay any penalties for damages, noncompliance, failure to meet any of the terms and conditions or household rules described there in.
5. Payment:
5.1 Bookings shall be confirmed in writing (email) by the owner on payment of a deposit (said confirmation does not refer to the Booking Application Form).
5.2 Receipt of any deposit prior to the owner’s written confirmation of the reservation shall not constitute acceptance of any booking.
5.3 The full payment shall be payable with your booking request prior to the commencement of the holiday.
5.4 All payments shall be made to the owner by bank deposit, e-transfer, money order or in cash only.
6. Cancellation:
Any cancellation made by the Vacationer shall be in writing addressed to the owner. On receipt of such notice of cancellation, the owner shall endeavor to re-book the cottage for the entire period of the original booking.
6.1 If the owner is successful in re-booking the cottage for the entire period originally booked it shall refund to the Vacationer all monies paid (whether by deposit or otherwise) less a cancellation fee of $100.00 per period booked.
6.2 If the owner only succeeds in re-booking the cottage for a portion of the period originally booked, it shall refund the monies paid relating to the period re-booked, less a cancellation fee of $100.00 per period booked.
6.3 If the owner is unable to re-book the cottage at all then all monies paid by the Vacationer (whether by deposit or otherwise) shall be forfeited to the Owner.
7. Representation:
The information contained in any printed materials or internet web page is believed to be accurate at the time of printing/viewing. However, the owner reserves the right to make alterations thereto and the owner shall endeavor to inform the Vacationer of such alterations. If the alterations relate to fundamental elements or services, the owner shall attempt to provide comparable fundamental elements or services. If these comparable elements or services prove unacceptable to the Vacationer, the owner shall bear no responsibility other than to provide an appropriate refund for those unavailable fundamental elements or services.
7.1 Fundamental elements refer to water systems, plumbing and electrical systems, major appliances, such as refrigerator and stove.
7.2 Fundamental elements do not refer to recreational items such as boats. These elements are provided at the discretion of the owner as an added feature for the Vacationers use. While every attempt will be made to ensure that such equipment is in working order during a holiday, should breakdown or some other situation occur whereby these elements are not available for the term of the holiday, Owner will not take responsibility for replacing the elements or
refunding any part of the rent to Vacationer for the lack of use of these elements.
7.3 Owner will not accepts responsibility for weather conditions or changes to water levels or conditions at the cottages.
8. Number of Persons using the Holiday Accommodation:
The number of persons present overnight and during the day on the property shall not exceed the number of guests listed on the booking agreement (Form: staying info), without prior authorization from the owner.
8.1 Vacationers who contravene the maximum numbers of adults and children (individuals 18 years old and older at considered adults ) permitted at the cottage will be subject to immediate eviction without refund or an additional nightly charge of $50.00 per person, at the discretion of the Owner.8.2 There will be no subletting of the cottage property permitted. Where separate parties will be occupying the property at different time periods, booking
forms must be completed for each party.
8.3 There shall be no camping, tenting, or otherwise placing auxiliary accommodation facilities on the property without prior written authorization.
9. Access:
The Cottage Owner shall be allowed access to cottage at any reasonable time during any holiday occupancy.
10. Repair:
10.1 The Vacationer shall keep the cottage and all furniture, fixtures, chattels, fittings, and effects in or about the holiday accommodation in the same state of repair and condition as at the commencement of the holiday, and shall leave the cottage in the same state of cleanliness and general order in which it was found. Failure to do so, to the satisfaction of the Owner, may result in a damage/cleaning charge being levied.
10.2 The Vacationer shall not rearrange the furniture or fixtures in the house.
11. Other Conditions of Booking:
The Vacationer shall abide by the conditions of booking and any other instructions contained in the Household Rules/ Note to guest, Inventory Listing and/or as noted on the face of this form. All such conditions apply to guests visiting the property, whether day visitors or overnight.
11.1 Any Vacationer who contravenes said conditions shall be subject to immediate eviction without refund and/or a penalty of $100.00 per day at the discretion of the owner.
12. Pets:
12.1 Pets are not permitted on the property.
13. Inventory Listing/Household Rules/Note to guest /Route Directions/checklist /Booking Confirmations:
The owner will provide a guiding rule document as what to expect during cottage visit, route Directions for the cottage, a checklist once the total cost of the vacation rental has been received. These documents shall be considered to be an extension of this Booking Terms and Conditions and the Vacationer shall abide by all instructions and information contained therein. If the Vacationer has not received these documents one week prior to the holiday period, the Vacationer shall notify the owner and obtain said documentation.
14. Keys:
14.1 The Vacationer agrees to return the cottage keys as directed in the house rules/note to guest
14.2 The Vacationer agrees to pay a $250.00 charge for failure to return the keys within the stipulated time.
15. Consumer Report:
The Vacationer is hereby notified that a consumer report containing credit and / or personal information may be referred to in connection with this transaction and authorize the owner to obtain such a report.
16. Proof of Insurance Coverage:
The owner reserves the right to request for proof of a home/contents insurance of each Vacationer to demonstrate that any damage made at the property will be covered by the Vacationer’s home/contents insurance.
17. Electronic Documents Act:
By selecting “I Agree, Reserve this Property” on the booking interface of the cottagewhitelake.com web site, or rent through email confirmation the Vacationer understands and agrees that they are entering into a legal binding agreement as per the authority Ontario Electronic Commerce Act, RSO 2000.
NOTICE
18. Linens and towels are not provided with the cottage due to hygienic issue. Vacationers are requested to bring their own Linen and Towels for personal use.
19. Cottage in rural area does not have any waste disposal system. Vacationer need to remove any waste at their own arrangement.
20. For any reason if the cottage becomes uninhabitable due to failure of water /electrical/heating/cooling systems or due to any natural calamities beyond owners control, owner would inform the vacationer as soon as possible to cancel the booking. Vacationer will be reimbursed the full/partial rental as applicable and shall not be liable or compensate except the money paid by the vacationer.
21. During the pandemic situation government may bring changes in social gathering or social distancing guideline and laws. It is the vacationers/ guest responsibility to check the applicable laws or guideline and maintain the same at the time of their visit. During the pandemic government laws and guideline will supersede the clause no 8 and sub clauses regarding maximum no of guest allowed in the property.
